CHEHARDY, Judge.
This is an appeal by defendant, a minor, William G. Bush III, through his natural father, William G. Bush, Sr., from a judgment favoring plaintiff, Phillip A. Reed, for medical expenses incurred for his son’s treatment resulting from the third degree burns sustained by the minor when a Christmas tree stand caught fire and burned him.
The minor was hospitalized at the emergency room of Touro Infirmary on December 26, 1981 for treatment of burns sustained when he was trapped in a Christmas tree stand fire that occurred after the minor was hit by a falling log. An emergency room report states that the minor was burned on his lower back, shoulders, waist and legs. Defendant has admitted liability to the minor for his injuries, and the sole issue presented for our determination is plaintiff’s claim for $1,817.91 for medical expenses.
Defendant contends that the trial judge erred in allowing the introduction of certain medical bills into evidence because the bill was based on an unfulfilled contractual obligation.
It appears that plaintiff initially filed suit on January 19, 1982. However, he subsequently was dismissed from that action. The minor was then placed in the custody of his
